Delhi HC: Chargesheet Under NDPS Act Valid Even Without Forensic Report

The Delhi High Court has reiterated that a chargesheet under the NDPS Act is not rendered incomplete merely because the Forensic Science Laboratory (FSL) report is absent at the time of filing.

A division bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar held that once a chargesheet satisfying Section 173(2) CrPC is filed within 180 days, the right to default bail under Section 167(2) ceases. 

The Court dismissed Rahimullah Rahimi’s plea, where 1.4 kg of heroin was seized, holding that the supplementary filing of the FSL report later does not invalidate the prosecution’s case.
