Delhi High Court Restrains YouTube Influencer from Defaming BROCODE Brand

The Delhi High Court has restrained Praveen Aminigadda, operator of the YouTube channel "Sipp_Smart", from uploading or circulating videos defaming alcoholic beverage brand 'BROCODE'.

The Court acted after a video labelled the drink as “poisonous” and “not fit for consumption,” directing its removal and instructing Google LLC to delete it if the influencer failed to comply.

Indospirit Beverages Pvt. Ltd., makers of BROCODE, filed the suit citing trademark infringement and defamation under trademark and intermediary liability laws.

The Court found a prima facie case, noting FSSAI and BIS certifications, and observed that such content harms the brand’s reputation and goodwill.
