The Delhi High Court set aside an injunction restraining Adyar Gate Hotels from using the name and mark 'Dakshin' for their standalone Chennai restaurant.
A Division Bench ruled that Adyar Gate had used the mark since 2015 without objection.
The court permitted Adyar Gate to use 'Dakshin' for its existing outlet but restricted expansion. ITC, which registered the mark in 2000, claimed infringement. Adyar Gate challenged the injunction, arguing it was issued without notice.
The Division Bench quashed the order, allowing Adyar Gate to operate under 'Dakshin' until final resolution.
The case will be reconsidered by a single judge on March 18, 2025.
