Passovers and Adjournments Cannot Be Claimed as Rights : Delhi High Court

The Delhi High Court has warned that pass-overs or adjournments granted to counsel are “courtesies” not a matter of right, and must not be abused to delay proceedings or prejudice the other side. 

In this case, a suit pending since 2006, the court noted that the plaintiff’s counsel repeatedly sought adjournments, gave inconsistent excuses (first illness, then family exigency), and even made false statements.

It was observed that such courtesies cannot be misused to delay proceedings or prejudice the opposite party.
