
The Delhi High Court has issued a permanent injunction against unknown individuals fraudulently using the 'Peak XV Partners' name and trademark.
XV Partners Advisors India LLP, formerly Sequoia Capital India & SEA, filed the suit, alleging that the defendants ran a fraudulent investment scheme under the fake website “https://pakxv.joyppp.com/” and mobile app “PAK XV.”
Investors were misled into believing they were dealing with the firm, but no returns were received by the investors. The court ruled this as a case of passing off, highlighting the clear intent to deceive.
Since the defendants were absent, the Court issued a summary judgment under Order 8, Rule 10 of the CPC, permanently restraining them from using Peak XV's trademark.
