Delhi High Court questions law allowing Indraprastha University affiliation to colleges outside Delhi

The Delhi High Court has raised significant constitutional concerns over the power of Guru Gobind Singh Indraprastha University (GGSIPU) to affiliate colleges located beyond the National Capital Territory of Delhi.

During a PIL hearing, the Court questioned whether the Delhi Assembly possessed legislative competence to grant such extra-territorial authority, potentially infringing Articles 239AA and 245 of the Constitution

It also noted that the practice may conflict with University Grants Commission rules that forbid franchising or affiliations outside a university’s legal jurisdiction.

The Court has issued notices to GGSIPU, the Delhi government, and the UGC and directed parties to file their submissions. The matter will proceed in due course.
