Delhi HC Raps Growing Trend of Impostors Filing Cases as Fake Property Owners Against Illegal Construction

The Delhi High Court dismissed a writ petition by a litigant falsely posing as a property owner to challenge alleged illegal construction, calling it an “arm-twisting” tactic to extract undue favours from builders.

Justice Mini Pushkarna noted that only genuine owners or immediate residents can file such petitions, and pretending otherwise constitutes abuse of the court process.

The petitioner’s claim of ownership was found dubious, as he had not pursued civil action to reclaim possession, indicating malafide intent.

The petition was dismissed, and the petitioner was ordered to pay ₹50,000 as costs to the Delhi High Court Bar Clerk’s Association.
