The Delhi High Court reduced a Protection of Children from Sexual Offences (POCSO) Act, 2012 (POCSO) convict’s three-month sentence to the period already undergone during investigation, noting the reformative purpose of imprisonment.
The appellant, convicted under Section 12 of the POCSO Act and Sections 354A, 354D, and 506 of IPC for sexually harassing a minor in 2015, had not challenged his conviction but sought leniency.
The Court observed that he was 18 years old at the time, had since integrated into society, and had not repeated such conduct.
Finding no attempt to contact the victim during a decade-long trial, the Court commuted his sentence.
