Delhi High Court Dismisses Plea Against India–UAE Extradition Treaty Clause

The Delhi High Court dismissed a petition challenging Article 17 of the India–UAE Extradition Treaty, which permits prosecution in India for offences connected to those forming the basis of extradition.

The Division Bench held that the petition was not maintainable as it sought no consequential relief and disclosed no actionable cause.

The Court observed that an extradition treaty does not acquire statutory character unless enacted by Parliament and therefore cannot be subjected to constitutional scrutiny.

The Bench granted liberty to file a properly framed petition but rejected the present plea.
