Delhi High Court Declines PIL Seeking Rotation in Minorities Commission Leadership

The Delhi High Court has declined to issue directions on a Public Interest Litigation seeking appointment of Chairpersons from minority communities other than Muslims and Sikhs to the National Commission for Minorities.

The petitioner argued that out of sixteen Chairpersons so far, fourteen were Muslims and two were Sikhs, contending that Christians, Buddhists, Jains, and Zoroastrians also deserve representation.

The Court observed that the National Commission for Minorities Act, 1992, does not require rotational appointments among all minority groups and that such decisions lie within the executive’s policy domain. 

The Court therefore refused to intervene, holding that no judicial directions could be issued in this regard.
