
The Delhi High Court issued a permanent injunction in favor of Himalaya Global Holdings Ltd. against trademark infringement of its liver care product ‘Liv.52’ by ‘Liv-333’.
Justice Mini Pushkarna ruled that even minimal confusion about medicinal products can have serious health consequences for consumers, medical practitioners, and pharmacists.
The Court ordered Rajasthan Aushdhalaya Pvt. Ltd. to pay ₹30.91 lakh in costs and damages for continuing sales despite an injunction and failing to file a written statement.
The Court ruled that adding ‘333’ did not distinguish it from the infringing ‘LIV’ mark and permanently restrained the defendants from using it.
