Delhi High Court Restrains Sale of Counterfeit ‘Hero Genuine Oil’ Bottles, Directs Seizure

The Delhi High Court granted an ex parte ad interim injunction in favour of Hero Investcorp Pvt. Ltd., restraining a trader from manufacturing, distributing, or selling counterfeit ‘Hero Genuine Oil’ bottles that infringed the company’s registered trademarks and bottle designs.

Justice Tejas Karia observed that the impugned bottles were identical in labelling and design to ‘HERO’, likely causing confusion among consumers. The Court prohibited the trader from using the ‘HERO’ mark or any deceptively similar packaging.

Further, the Bench appointed a Local Commissioner to visit the trader’s premises, seize counterfeit bottles, packaging materials, and other related items, ensuring enforcement of the injunction and protection of trademark rights.
