Delhi HC Restrains 'Wow Delicious' Over Trademark Infringement

The Delhi High Court issued an interim order restraining 'Wow! Delicious,' a Gurgaon restaurant, using a trademark resembling 'Wow! Momo,' a fast-food chain with over 600 outlets in India.

It was contended that the use of the name 'Wow! Delicious' infringes upon 'Wow! Momo's registered trademark, causing potential confusion under the Trademarks Act, 1999.

'Wow! Momo' argued its trademark, registered under classes 43 and classes 30, was being infringed, with 'Wow! Delicious' leveraging its goodwill and likely misleading the public.

The Court granted an ex-parte interim injunction. The matter is scheduled for a hearing in April 2025.
