Delhi High Court Grants Ex Parte Injunction Against Online Seller for Trademark Infringement

The Delhi High Court granted an ex parte ad interim injunction restraining Agrim Wholesale Pvt. Ltd. and others from infringing Dhanuka Agritech Ltd.’s trademarks, including “DHANUKA”, and from passing off or selling counterfeit goods.

Justice Tejas Karia found a prima facie case of deception, noting Dhanuka’s long-standing use and goodwill.

The defendants were directed to remove infringing listings and stop unauthorised trade via e-commerce platforms.

A Local Commissioner was appointed to seize infringing products and collect details of the supply chain. The matter is listed for January 29.
