Delhi High Court Ruled Schools Can't Deny a Child's Transfer Certificate Due to Parental Disputes

The Delhi High Court held that a school cannot deny a transfer certificate to the child due to ongoing parental, matrimonial, or guardianship disputes.

The case involved Montfort School refusing a TC to a girl who moved to Gurugram with her mother after her parents' separation. The School denied the TC because girl's father wrote a letter to the school against it. 

The court emphasized that the child's best interest is paramount even in the case of parental disagreements. Despite the father's objections, the court ordered the school to issue the transfer certificate to the child within one week.

The Court warned that any further delay would attract disciplinary action against the school authorities.
