
The Delhi High Court upheld an interim injunction restraining Sabu Trade Pvt. Ltd. and certain family members from using the trademark “Sachamoti,” a reputed brand of sabudana products.
A Division Bench of Justices V. Kameswar Rao and Vinod Kumar held that the registered proprietor, Rajkumar Sabu, had established a prima facie case of ownership under Section 31 of the Trade Marks Act, 1999.
The Court found that the defendants’ claim of prior use required evidence and directed that the restraint on the use of the mark continue until the dispute’s final adjudication.
