
The Delhi High Court has held that an arbitrator could not be removed solely based on unproven allegations of corruption.
The bench ruled that unsubstantiated claims are insufficient to terminate an arbitrator’s mandate and may themselves undermine the fairness of the arbitration process.
NHIDCL had sought the removal of an arbitrator, alleging his involvement in a pending corruption case and claiming bias.
The Court rejected this, noting there was no evidence or finding by any forum substantiating the allegations, and emphasised that credible proof of bias or misconduct is essential to justify removal.
