The Delhi High Court has upheld the center’s decision to revoke security clearances of Turkish-owned Çelebi Airport Services, citing overriding national security concerns.
Justice Sachin Datta ruled that principles of natural justice must give way when national security is at stake, particularly given Indo-Pak tensions and Turkey’s pro-Pakistan stance. Justice Sachin Datta noted that judicial review doesn't apply in such cases.
The decision followed classified intelligence inputs reviewed in sealed cover, revealing espionage risks due to Çelebi’s airside access.
Çelebi argued the move was vague and hurt investor confidence, but the court backed the government’s powers under the Bharatiya Vayuyan Adhiniyam, 2024, and Aircraft Act, 1934. Çelebi's petitions were dismissed.
