Delhi High Court Upholds Validity of Dental Council Regulations Requiring NOC from State

The Delhi High Court has upheld the Dental Council of India Regulations, 2006 governing the establishment of new dental colleges, courses, and admission capacity.

The Court clarified that Regulation 6(e), which mandates a No Objection/Essentiality Certificate from the concerned State Government or Union Territory, is valid.

The ruling came on a challenge which sought to set up a dental college in Assam, arguing that the regulations were not laid before Parliament and that an NOC was unnecessary. 

Dismissing the plea, the Court held that the NOC requirement is a legitimate safeguard in medical and dental education.
