Delhi High Court Upholds Father’s 10-Year Sentence For Raping 9-Year-Old Daughter

The Delhi High Court upheld the conviction and 10-year sentence of a man for repeatedly raping his 9-year-old daughter in 2017.

The Court observed that the prosecution established the case through medical and forensic evidence, including DNA reports, which matched the father’s blood sample with exhibits collected from the child.

The Court said that although the child victim and her mother turned hostile, corroborated evidence and findings under Section 29 of the POCSO Act sustained the conviction.

Dismissing the appeal, the Court held that hostile testimony cannot erase credible supporting evidence.
