MCD Can Collect Conversion Charges on Commercial Use of Industrial Plots : Delhi High Court

The Delhi High Court has upheld the Municipal Corporation of Delhi’s (MCD) authority to issue show cause notices and levy conversion charges on industrial plots used for commercial purposes, such as banquet halls and IT/ITES offices.

Justice Purushaindra Kumar Kaurav ruled that the Delhi State Industrial and Infrastructure Development Corporation (DSIIDC) lacks statutory power to regularise such use under the DIDOMA Act, 2010.

The Court relied on the Delhi Municipal Corporation Act, 1957, and Master Plan Delhi 2021.

Petitioners must respond within two months, after which MCD to issue speaking orders within four months.
