Delhi High Court: DV Complaint Can’t Be Dismissed Just Because Wife Didn’t Mention Exact Dates of Abuse

The Delhi High Court held that a domestic violence complaint cannot be dismissed merely because the wife didn’t mention specific dates of alleged abuse.

Setting aside a family court’s order, the Court restored the monthly maintenance of ₹4,000 each to the wife and her minor child. It noted that the woman had made consistent and detailed claims of dowry demands, physical violence, and economic abuse.

The Court also observed that the husband neither justified her leaving the matrimonial home nor sought restitution. A prior CAW complaint strengthened the wife’s case, the Court added.
