Delhi High Court Acquits Man in POCSO Case Over Insufficient Evidence

  • Case Name: Sahjan Ali Through Parokar Banu Khatun v. State Through SHO PS Madhu Vihar
  • Judge(s): Justices Prathiba M Singh and Amit Sharma
  • Advocate(s): Yashvir Sethi, Ritesh Kumar Bahri

The Delhi High Court acquitted a man convicted under Section 3 of the POCSO Act and Section 376 of IPC for allegedly raping a 14-year-old girl.  The court found the evidence, including the complainant’s use of “physical relations,” insufficient to prove sexual assault.

While the trial court sentenced the accused to life imprisonment based solely on the girl’s age, the High Court noted the survivor denied the assault, and medical examinations showed no injuries.

Ruling that age alone cannot justify conviction, the court granted the accused the benefit of the doubt and overturned the sentence.
