Delhi High Court Allows 27‑Week Pregnancy Termination for 16‑Year‑Old Rape Survivor

A Division Bench of the Delhi High Court permitted a 16-year-old rape survivor to terminate her 27-week pregnancy under the Medical Termination of Pregnancy (MTP) Act.

Despite AIIMS reporting a viable fetus and expressing concerns about future reproductive health, the Court prioritised the girl's mental trauma, concluding she was unwilling to continue the pregnancy. 

The Court noted the psychological trauma faced by the girl, who was sexually assaulted twice. The court emphasised the family's consistent stand and prioritised the minor's health and reproductive future over gestational limits.

The bench directed AIIMS to proceed with the procedure promptly, ensure post-operative care, and preserve fetal tissue for DNA testing. The Court also tasked the Delhi Government with covering medical expenses.
