The Delhi High Court directed the Commissioner of Police to take corrective steps to ensure that investigating officers brief prosecutors before bail hearings and remain present with the complete case file.
The Court observed while granting bail to an accused in a murder case, noting that neither the IO nor the SHO appeared, and the prosecutor was not properly briefed. The Court found that apart from a confessional statement, no substantive evidence had been collected.
It granted bail and sent a copy of the order to the Police Commissioner for necessary action.
