Delhi High Court Awards ₹1.2 Crore to Johnson & Johnson in ORSL Trademark Case

The Delhi High Court awarded ₹1.21 crore in damages to Johnson & Johnson over trademark infringement of its ORSL brand.

Justice Mini Pushkarna ruled that the defendant’s mark “ERSL” was deceptively similar, satisfying the ‘Triple Identity Test’ of similar mark, trade dress, and consumer base. 

The Court found deliberate imitation in packaging, colour scheme, and font design. 

The court made permanent the earlier interim injunction and directed the defendants to pay both compensatory and punitive damages, noting they continued using similar marks despite the prior court order.
