Delhi High Court Refuses to Stay Order Restraining Use of ‘Bro Code’ Film Title

The Delhi High Court has declined to stay a single judge’s order restraining Ravi Mohan Studios from using the title “Bro Code” for its upcoming film.

A Division Bench of Justices C Hari Shankar and Om Prakash Shukla observed that granting a stay would virtually amount to allowing the appeal. The injunction had earlier been granted in favour of Indospirit Beverages, the owner of the “Bro Code” trademark for its beverage line.

The Bench sought clarification on the statutory basis for the injunction under Section 29 of the Trade Marks Act and ordered that the interim restraint will continue until the appeal is decided.
