The Delhi High Court has recommended that the Rights of Persons with Disabilities Act be amended to allow for the indefinite carrying forward of unfilled reserved seats for Persons with Disabilities (PwD) in educational institutions.
The court observed that the current one-year carry-forward rule leads to a perpetual loss of seats for PwD candidates if they remain vacant, defeating the purpose of the reservation.
It directed the University Grants Commission (UGC) to issue appropriate guidelines to ensure PwD candidates do not lose their entitled seats and to consider amending the law for a more robust mechanism.
