Delhi HC Calls for Urgent Review of Baggage Rules for Carrying Gold Jewellery while Travelling

  • Case Name: Qamar Jahan v Union of India
  • Judge(s): J. Pratibha M. Singh, J. Dharmesh Sharma

The Delhi High Court has urged the Central Board of Indirect Taxes and Customs (CBIC) to revise the Baggage Rules, 2016, to address outdated gold limits and prevent harassment of genuine air travellers.

As Per Rule 5, male passengers can bring 20 grams of gold worth ₹50,000 duty-free, while females can bring 40 grams worth ₹1,00,000. However, rising gold prices make 40 grams exceed ₹1,00,000.

The Court criticised Customs' arbitrary powers, stressing fair treatment for OCI cardholders and People of Indian Origin attending Indian marriages.

The CBIC must propose changes by March 27, 2025.
