
The Delhi High Court clarified that its interim order concerning the ORS trademark does not authorise companies to manufacture or market oral rehydration salts without requisite approval.
The clarification came while protecting JNTL Consumer Health India, a subsidiary of Kenvue, against the Food Safety and Standards Authority of India’s (FSSAI) directive restricting beverages from using the term “ORS.”
The Court observed that its earlier order was limited to procedural relief and should not be interpreted as conferring a license to operate in violation of statutory norms. Emphasising that trademark rights continue to be enforceable.
The Bench has scheduled the matter for a detailed hearing on October 31.
