Delhi High Court: Concealing Marital History Makes Marriage Voidable Under Hindu Marriage Act

The Delhi High Court held that concealing one’s marital history amounts to suppression of material facts, rendering a marriage voidable under Section 12(1)(c) of the Hindu Marriage Act, 1955.

The Court dismissed a husband’s appeal against a family court order annulling his marriage for misrepresenting his status as “never married” on a matrimonial portal.

The court observed that “never married” and “unmarried” are distinct, while the former indicates no prior marriage, the latter could include divorced or widowed persons. 

Since the husband falsely projected himself as “never married” and failed to disclose his prior marital status, the Court upheld annulment.
