Delhi High Court Declares 'Taj' a Well-Known Trademark in Hospitality Industry

The Delhi High Court has recognized "Taj" as a well-known trademark for hotels and hospitality services. Justice Amit Bansal cited its long-standing use, wide recognition, and goodwill both in India and internationally.
The suit was filed by Indian Hotels Company Limited (IHCL), a TATA Group entity, against multiple individuals for trademark infringement, copyright violations, and passing off services under similar names.
The Court ruled that IHCL met the criteria under Sections 11(6) and 11(7) of the Trademarks Act, affirming "Taj" as a well-known trademark under Section 2(1)(zg).
The Court also noted that IHCL’s 'Vivanta' brand was declared a well-known trademark in 2022.
