The Delhi High Court ruled that routine administrative delays, such as "file movement" or changes in legal representation, do not constitute "sufficient cause" to condone delay in filing appeals under Section 37 of the Arbitration and Conciliation Act, 1996
The bench, while hearing an S.37 appeal, emphasised the act’s primary objective of ensuring speedy dispute resolution and the necessity of strict adherence to the 30-day limitation period.
The court noted that internal procedural lapses cannot serve as valid justifications for delays.
The court reiterated that litigants requesting condonation must provide specific and compelling reasons, rather than depending on routine administrative issues or bureaucratic delays.
