The Delhi High Court upheld a Family Court order granting interim custody of a four-year-old boy to his father, citing the mother’s persistent neglect and abdication of parental duties.
A Division Bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar noted that allegations of adultery alone cannot determine custody.
The Court observed that the mother's deliberate neglect and disregard for court proceedings were detrimental to the child's welfare.
Prioritising the child’s best interests, the Court affirmed the Family Court’s order, granting the father full interim custody and the mother limited visitation.
