Delhi High Court Directs Delhi Government to Make Ad-Hoc Appointments of Public Prosecutors

  • Case Name: Court on Its Own Motion v. State of NCT of Delhi

The Delhi High Court ordered the state government to make ad-hoc appointments of Additional and Assistant Public Prosecutors in criminal courts, pending regular recruitment.

The Bench instructed the government to ensure one prosecutor per court within four weeks, through direct recruitment or ad-hoc promotion.

The bench was hearing a suo moto case registered in 2009 after a letter petition was moved highlighting the issue of undertrials languishing in jail for 5 to 12 years without a trial.

The Court also asked for a fresh affidavit detailing a roadmap to permanently fill the positions. The matter will be heard again on September 12, 2025.
