Delhi HC Dismisses PIL Against AAP’s ‘Spam’ Calls on Freebies, Asks ECI to Ensure Fair Elections

  • Case Name: Dhrone Diwan & Ors v. ECI & Ors
  • Judge(s): CJ Devendra Kumar Upadhyay and Tushar Rao Gedala

The Delhi High Court dismissed a Public Interest Litigation filed by three lawyers, including Dhrone Diwan, against AAP’s alleged "spam" calls promoting freebies before elections.

The petition claimed these calls vilified opponents and coerced voters.

A Bench directed the Election Commission of India (ECI) to act on complaints and prevent any vilifying material in campaigns.

The Court upheld ECI’s authority under Article 324 of the Constitution to ensure free and fair elections.

The PIL’s request to postpone elections was denied, affirming ECI’s existing regulations on political advertisements and campaign conduct.
