Delhi High Court Restrains Urban Electric From Using ‘Destiny’ Marks in Hero MotoCorp Trademark Suit

The Delhi High Court granted an ex parte ad-interim injunction favoring Hero MotoCorp, restraining Urban Electric Mobility and associated entities from using the marks ‘DESTINY’, ‘DESTINY+’, and ‘DESTINY PRO’ for electric scooters.

Justice Tejas Karia noted that Hero is the registered proprietor of similar marks, including ‘DESTINI’ and ‘DESTINI PRIME’.

The defendants’ marks were found visually, phonetically, and structurally identical and deceptively similar, causing consumer confusion and misrepresentation, particularly with the use of ‘HERO’ by defendants 1–3.

The Court held that Hero made out a prima facie case and would suffer irreparable harm if the defendants continued using these marks, ordering them to cease all related activities immediately.
