Delhi High Court Restrains Patna ‘Burger Singh’ Outlet from Using Trademark

The Delhi HC issued an ex‑parte ad interim order restraining a Patna outlet from unauthorized use of the trademark “BURGER SINGH” after its franchise agreement with Tipping Mr Pink Pvt Ltd expired.

Justice Jyoti Singh found a prima facie case of trademark infringement and passing off, as the outlet continued using the brand name, hoardings, menus, and promotional materials post-termination.

A local commissioner was appointed to inspect the outlet and seize infringing materials, with a report due within two weeks.

The injunction bans the use of “BURGER SINGH” or confusingly similar marks by the Patna franchise until further orders.  (Tipping Mr Pink Pvt Ltd v. Dr Prabhat Ranjan)
