The Delhi High Court granted an interim injunction restraining Indian bus manufacturers and service providers from using Volvo’s trademark and signature grille/slash design.
The Court found that over 100 replica buses had been manufactured and sold using fake Volvo branding, amounting to infringement, passing off, and a violation of statutory and common law rights under the Trade Marks Act, 1999.
The court held that the misuse was deliberate and aimed at exploiting Volvo’s global goodwill for business gains. The Court prohibited defendants from manufacturing, selling, advertising, or operating any buses displaying the Volvo mark or grille design.
The next hearing is scheduled for October 9.
