
The Delhi High Court has granted interim relief to Allcargo Logistics Limited, restraining a rival firm from using the mark “VRS ALLCARGO” and similar variants.
Justice Tejas Karia held that the impugned mark prima facie infringes Allcargo’s registered “ALLCARGO” trademarks and amounts to passing off.
The Court noted that the defendants had adopted the mark in its entirety, which likely caused consumer confusion, especially since both parties operate in identical logistics services through similar trade channels. It also directed the suspension of the defendants’ websites within 24 hours.
