Delhi High Court Issues Permanent Injunction, Awards Damages in Creed Trademark Case

The Delhi High Court granted a permanent injunction in favour of Fontaine Limited in a trademark infringement action concerning the CREED perfume brand.

The Court held that a Delhi-based retailer continued selling CREED-branded products after the expiry of its distribution agreement and engaged in the unauthorised use of registered marks.

The Court held the defendant liable for selling counterfeit goods, which resulted in brand dilution and misled consumers.

The Court awarded ₹37.42 lakh as compensatory and punitive damages and restrained the defendant from further use of the CREED mark or sale of any CREED-labelled products.
