Delhi High Court Grants Refund Where Suit Was Rejected Without Merits

The Delhi High Court observed that payment of court fees should not act as a deterrent for litigants seeking justice.

The case arose from a commercial suit filed by RI Networks Private Limited, which was rejected at the initial stage on jurisdictional grounds. The Court noted that since the suit was dismissed on the first day without examination of its merits, refusal to grant a refund was not justified.

It held that the distinction between rejection under Order VII Rule 10 or Rule 11 of the CPC was not relevant for deciding the refund.

The Court accordingly ordered refund of the court fees, adopting a liberal approach towards the litigant.
