The court found that the "Croose" mark was an intentional imitation, taking unfair advantage of Crocs' distinctive reputation. The Court also held that the similarity in sound and visual appearance was likely to cause confusion among consumers.
The court also noted the lack of a credible explanation from the "Croose" registrant for adopting such a similar mark, further supporting the finding of bad faith.
The order permanently restrains the defendant from using the "Croose" mark.
