The Delhi High Court has reduced the maintenance awarded to a wife and child, holding that a husband’s liabilities, including home loan EMIs and responsibility towards parents, must be factored in.
Justice Neena Bansal Krishna observed that maintenance should ensure adequate support for the wife and child, but also balance the husband’s financial obligations.
The Court modified the family court’s order of ₹25,000 per month, reducing it to ₹17,500.
The bench noted that the husband was paying ₹11,000 EMI monthly, while the wife failed to disclose details of her income and expenses.
