Delhi High Court imposed temporary injunction Against the Rogue Websites Infringing Trademark

  • Case Name: Moonshine Technology Private Limited vs. Ashok Kumar & Ors
  • Judge(s): Justice Mini Pushkarna

The Delhi High Court imposed a temporary injunction against the 'rogue websites' from using domain names infringing the trademark of Moonshine Technology Private Limited, the parent company of "Baazi Group" of Companies which provides online gaming products and services.

The plaintiff, Moonshine Technology Pvt Ltd alleged the defendant is infringing their registered trademark "BAAZI" to run gambling and casino platforms, with the mala-fide intention to deceive users about their association with Moonshine.

The plaintiff contended the acts of the defendants are causing harm to the well-established brand and are illegal.

Justice remarked that the balance of convenience lies with moonshine, the plaintiff, and irreparable harm can be caused if an interim injunction is not granted.
