
The Delhi High Court clarified that Indian currency can be seized under Section 63 of the Foreign Exchange Regulation Act, 1973.
The ruling came in an appeal against orders by the Enforcement Directorate and the Appellate Tribunal for Foreign Exchange, which had confiscated ₹12.31 lakh and imposed a ₹40,000 penalty on the petitioner.
The Court held that the language of Section 63 is wide enough to cover Indian currency and that the provision serves its intended purpose clearly.
The Court held that under FERA, High Court appeals are confined to questions of law, not factual determinations.
