Delhi High Court: Medical Diagnosis of Bipolar Disorder Cannot Automatically Stop Transfer

The Delhi High Court ruled that a medical diagnosis of Bipolar Disorder alone is not sufficient to claim protection from transfer under government rules.

The Court explained that simply having a medical certificate does not automatically stop an employee’s transfer. Authorities must examine whether the illness seriously affects the person’s health, work performance, or ability to relocate.

The Court emphasized that proper medical evidence and the actual impact of the condition must be shown.

Therefore, decisions about transfer should be based on a careful evaluation of the employee’s situation, not only on the diagnosis.
