The Delhi High Court modified an interim injunction against Patanjali Ayurved, allowing the company to continue using the phrase "ordinary Chyawanprash" in advertisements but restraining it from referring to "40 herbs," a reference linked to rival Dabur's product.
The Court held that using "ordinary" alone constitutes permissible puffery and does not amount to disparagement. Comparative claims linking Patanjali’s product to Dabur’s 40-herb formula remain restricted.
Following this order, Patanjali’s appeal was closed, while other substantive issues in the trademark and advertising dispute will continue for trial.
