
The Delhi High Court held that the non-resident Indian (NRI) is entitled to the benefit provided to an 'eligible passenger' under the Baggage Rules, 2016.
The petitioner was traveling from UAE to India, and despite being an eligible passenger, his 28-gram gold chain worn for personal use, was seized at Delhi Airport. The customs officials also imposed fines of Rs. 25,000 and warehousing charges of Rs. 250.
Furthermore, the court quashed the adjudicating authority’s order considering that personal jewelry is not liable to be confiscated, and directed the immediate release of the gold chain & refund of already deposited charges, emphasizing NRI’s baggage rights.
