
The Delhi High Court restrained various restaurants from using the marks “Dominic Pizza” & “Domindo Pizza” in a trademark infringement suit filed by Domino’s.
Justice Mini Pushkarna directed Swiggy and Zomato to delist the outlets from their platforms.
The court found a prima facie case for injunction, emphasizing that if no ex-parte ad interim injunction is granted, Domino’s will suffer irreparable loss.
The defendants were found guilty of using deceptive similar trademarks which amounted to infringement of Domino’s statutory rights as per Section 29 of the Trade Marks Act, 1999.
The court further restrained defendants from advertising, selling, or marketing under the disputed names.
